Probation revoked in Nebraska assault case

A Nebraska man had his probation revoked and was sentenced Monday in Dodge County, Nebraska District Court to serve one year in jail for attempted first-degree sexual assault.

Jason A. Ling, 33, of Round Lake, Minn., was sentenced on the Class III felony and was given credit for 275 days served.

Dodge County, Nebraska Judge John Samson said the case was troubling. Ling had choked his former girlfriend, who is now his wife, until she passed out. While she was unconscious, he sexually assaulted her, court records stated.

Samson said Ling received two benefits last year — the original charge of first-degree sexual assault was reduced and he received probation.

But Ling violated that probation by being arrested Feb. 25 in Minnesota for driving while intoxicated. That was 10 days after serving nine months in the Dodge County, Nebraska Jail, Samson said.

"There has to be a punishment for this," he said.


Ling seems to be doing well since his Minnesota arrest, the judge said.

Brad Nick, Ling's attorney, had requested the defendant be released unsatisfactorily from his probation. Ling is working and supporting his wife and three children, Nick said.

Nick said it was not surprising that Ling would be arrested in Minnesota soon after being released from jail here because he never was in a drug treatment program.

"There is no indication that he wants to drink or has been drinking (since his Minnesota arrest)," he said.

Dodge County, Nebraska Attorney Paul Vaughan disagreed with Ling being unsatisfactorily released, adding the assault was one of the most chilling incidents he has ever dealt with.

It was because of the victim he reduced the charge last year, Vaughan said. He recommended Ling serve at least one year in jail.

Other cases heard Monday included:

*A Feb. 18 jury trial was scheduled for Jesse J. Allen, 57, of Fremont for first-degree sexual assault. A psychologist determined Allen to be competent to stand trial and an innocent plea was entered by the court Dec. 1 after Allen stood mute to the charge.

Allen could face up to 50 years in prison on the Class II felony. He is accused of sexually assaulting a girl 16 years old or younger on July 19.

According to police reports, Allen told officers the assault could have happened, but he did not recall.

*William E. Guthrie, 24, of Fremont pleaded innocent to failure to register as a sex offender. A jury trial was requested. Attorneys have until Jan. 9 to file pretrial motions. A Jan. 12 hearing was scheduled.

He could received up to five years in prison and/or a fine up to 10,000 fine for the Class IV felony.

Guthrie's bond was reduced from $25,000 cash to 10 percent of $25,000.

Nick, Guthrie's attorney, requested the bond reduction. He has been in jail since his arrest and will reside at the Grand Island homeless shelter, he said.

Vaughan did not object to lowering the bond.

Guthrie failed to notify the court of his address after being released from the Dodge County, Nebraska Jail on the same offense. He was sentenced July 21 to serve 120 days in jail.

On Dec. 10, 2001, Guthrie was convicted in Adams County District Court of sexual assault of a child.

Guthrie is listed on the Nebraska State Patrol's Web site as a Level 3-High Risk offender. His address is listed as the Dodge County, Nebraska Jail.

*Jalan Henggeler, 34, of Omaha pleaded guilty to theft by shoplifting, a Class IV felony. A pre-sentence investigation was ordered. Sentencing was scheduled for Feb. 9.

Henggeler is serving time in the Nebraska State Penitentiary in York on a shoplifting charge out of Sarpy County.

The Dodge County, Nebraska charge stems from a Dec. 23, 2002, incident at Wal-Mart Supercenter, where merchandise valued at $822.22 was taken.

*Michael L. Lebs, 37, of Fremont pleaded innocent to possession of a controlled substance-methamphetamine, driving while under suspension and possession of drug paraphernalia. A jury trial was requested. Attorneys have until Jan. 23 to file pretrial motions. A Jan. 26 hearing was scheduled.

*April Rolenc, 25, of Hooper pleaded innocent to manufacture of a controlled substance-meth with intent to deliver and possession of drug paraphernalia. A jury trial was requested. Attorneys have until Jan. 23 to file pretrial motions. A Jan. 26 hearing was scheduled.

Rolenc could receive up to 20 years in prison and/or a fine up to $25,000 fine on the Class III felony. The drug paraphernalia charge is an infraction with a mandatory $100 fine.
